Terms of Service
This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:

1. GENERAL INFO
Clip Studio EX is my preferred software of use for the elaboration of Illustrations.
Art style to be used in the comissioned Artwork is up to discussion between Artist and Client.
Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.
Communication channels may include a Discord, Instagram or Twitter private messages, according to Artist discretion.
Artist response time may vary, up to 5 Business Days in order to provide better or more concrete updates.

2. PAYMENT
Full payment or a 50% deposit is required after the Artist finishes the proposal/rough draft.
Invoices and proposal will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment are sent by the Artist.
Invoices must be paid within 48 hours or the project may be cancelled.
Prices are in USD, and paid via VGen or PayPal as provided by the Artist.
Prices may vary or change depending on complexity, requirements and/or additional requests as stated in the Comission Table.
Once the payment (either full or partial) has been made and, the Client acknowledges the final artwork and deliverables are digital and there are no physically shipped goods to receive.
Client warrants they will not issue chargebacks and the refund policy mentioned in point 7 will be followed.

4. REVISIONS
4.1 About revisions included in the comission
The Client can ask for 1 revision per stage of the drawing. The stages are the ones mentioned in Point 3: Sketch, LineArt and Color. The stages to be included depend on the type of commission, as detailed in the Comission Table.
Major changes can only be made at the "Sketch" stage of the process. Only minor changes can be made at the "LineArt" and "Color" stages.
The Client has 2 Business Days to provide the comments for the revision. If no response is provided in that timeframe, the Artist will proceed with the following steps of the commission.
For comissions in Payment Plan (see Point 2), the revision of the last stage of the artwork can only be performed after the last payment is made.
4.2 About "SKEB/Surprise Me" and Additional Revisions
Any additional revisions will require additional fees, starting at $2 USD with each minor revision. More invasive revisions will inquire into a higher cost, up to discussion and agreement between both Artist and Client. Additional revisions may also result in a renegotiation of the deadline.
For "SKEB/Surprise Me" commissions the Artist will not provide any WIP nor revision.
5. DEADLINES AND DELIVERY
5.1 About Deadlines
In an usual setting in which no strict deadline has been stated nor agreed upon by both Artist and Client, once communicated to the Client by the Artist that work on the commission has been initiated, the comission may take up to 20 business days to be completed depending on complexity, revisions, workload and/or other factors.
Strict deadlines must be stated by the Client when making the request, and agreed by both the Client and Artist.
If any time extension is needed in either scenario, the Artist will promptly communicate with the Client for such discussion. Failure in reaching an agreement for an extension can be eligible for a refund (see point 7).
5.2 About Delivery
Upon delivery, the Client will recieve a link to download the comissioned Digital Illustration with and without watermark (PNG, 300 DPI, agreed Canvas Size).
6. RIGHTS AND USAGE
6.1 Rights of the Artist and Obligations of the Client
The Artist has a right to decline any request for any reason.
The Client must always credit the Artist for the artwork, and will not claim the artwork as made by the Client.
The Artist retains all the rights to the work, which include the right to distribute, reproduce and/or use the image in the Artist's portfolio and social media.
Posts on social media and portfolios will not be neither full resolution nor full sized, so that the Client remains the sole owner of the illustration in full size and resolution.
Distribution, reproduction and/or usage in the Artist's social media or portfolio will be performed only after the Client has given explicit consent to do so.
6.3 About the use of the artwork
If the commission has to remain private (not ever published anywhere), it must be explicitly stated by the commissioner.
Listed prices are for personal use only (using the image in any way that does not involve monetization).
Commercial use (such as selling prints, products, or any other kind of usage that involves making profit) must be discussed. For commercial illustration request please contact the Artist via the means stated at the bottom of this page.
AI Training and NFT use of the artwork is not allowed.
7. REFUNDS
A refund can only be initiated by the Artist if the artwork cannot be finished by the previously stated and agreed deadline and there's no agreement on an extension on said deadline. There are two possible scenarios:
If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund corresponding to the amount of work that was pending.
If work done up to this point is not accepted nor used by the Client, a full refund will be provided by the Artist.
The refund will be performed through a PayPal invoice sent by the Client to the Artist with the quantity agreed by both parts, not as a chargeback.
Refunds will not be performed in any other scenario.
